I. General information
The confidentiality of your personal data is one of the main concerns of Profinox as a personal data operator.
This document has the role of informing you about the processing of your personal data, in the context of using the website www.profinox.ro (hereinafter referred to as the “Website”)
II. Categories of personal data processed
If you are a visitor of the Website, Profinox shall process the personal data that you provide directly in the context of using the Website, such as the data that you provide in the contact / questions / complaints section, insofar as you contact us in this way.
III. Purposes and grounds for processing
If you are a visitor of the Website, Profinox processes your personal data as follows:
- for marketing activities, respectively for the transmission, through the means of communication at distance (email), of commercial communications regarding the products and services offered by Profinox, through the Website.
Grounds: The processing of your data for this purpose is based on your consent, if you choose to provide it.
You can express your consent for the processing of personal data for this purpose by filling in and checking the appropriate box on the offer request form available on the Website. In order to unsubscribe from receiving such commercial communications, you may use the option at the end of each email containing commercial communications.
The provision of your personal data for this purpose is voluntary. The refusal to provide consent for the processing of your personal data for this purpose shall not have negative consequences for you.

Grounds: The processing of your data for this purpose is based on the legitimate interest of Profinox to ensure the proper functioning of the Website, as well as to permanently improve the experience of the Website’s visitors, including by solving the various comments, questions or grievances.
The provision of your personal data for this purpose is voluntary. Refusal to provide personal data for this purpose shall not have negative consequences for you.
IV. Duration for which we process your data
As a matter of principle, Profinox shall process your personal data for as long as this is necessary to achieve the processing purposes mentioned above.
If you are a customer, we shall process your data for the entire duration of the contractual relationship and subsequently in accordance with the legal obligations incumbent on Profinox (for example in the case of financial-accounting supporting documents for which the retention period provided by law is 10 years from the end of the financial year during which they were drawn up).
If you withdraw your consent to the processing of personal data for marketing purposes, Profinox shall cease processing your personal data for this purpose, without affecting the processing carried out by Profinox based on the consent expressed by you before its withdrawal.
V. Personal data disclosure
For the fulfilment of the processing purposes, Profinox may disclose your data to partners, third parties or entities that support Profinox in carrying out its activity through the Website (for example courier companies, IT services providers), or to central/local public authorities, in the following exemplary listed cases:
- for Website administration;
- for the maintenance, customization and improvement of the Website and of the services provided by means of it;
- for the performance of data analysis, test and research, monitoring of usage and activity trends, development of security features and the authentication of users;
- for the transmission of commercial marketing communications, under the conditions and limits provided by law;

VI. Transfer of personal data
Personal data provided to Profinox may be transferred outside Romania, but only to European Union countries.
VII. Your rights
Under the conditions provided for by the legislation on the processing of personal data, as data subjects, you have the following rights:
- the right to information, respectively the right to receive details regarding the processing activities performed by Profinox, as described in this document;
- the right to access data, respectively the right to obtain confirmation from Profinox regarding the processing of personal data, as well as details on the processing activities such as the methods used for data processing, the purpose for which the processing is performed, the recipients or the categories of data recipients, and so on;
- the right to rectification, respectively the right to obtain the correction, without justified delays, by Profinox of the inaccurate / unjustified personal data, as well as the completion of incomplete data; The rectification / completion shall be communicated to each recipient to whom the data have been transmitted, unless this proves impossible or involves disproportionate effort.
- the right to delete data, without undue delay, (“the right to be forgotten”), if one of the following reasons applies:
- these are no longer necessary for the fulfilment of the purposes for which they were collected or processed;
- if the consent is withdrawn and there is no other legal basis for processing;
- if the data subject opposes the processing and there are no legitimate reasons prevailing;
- if the personal data have been processed illegally;
- if personal data must be deleted in order to comply with a legal obligation;
- personal data have been collected in connection with the provision of information society services in accordance with the Union law or the national law to which the operator is subject.
It is possible that, following the request for deletion of the data, Profinox may blur these data (thus depriving them of their personal character) and continue to process them under these conditions for statistical purposes;
- the right to restrict processing to the extent that:
- the person disputes the accuracy of the data, for a period that allows us to verify the correctness of the data;
- the processing is illegal and the data subject opposes the deletion of personal data, requesting instead the restriction of their use;
- the operator no longer needs the personal data for the purpose of processing, but the data subject requests them for finding, exercising or defending a right in court; or
- the data subject opposed the processing (other than the direct marketing ones), for the period of time in which it is verified whether the legitimate rights of the operator prevail over those of the data subject.
- the right to data portability, respectively (i) the right to receive personal data in a structured way, commonly used and easy-to-read format, and (ii) the right to have such data transmitted by Profinox to another data operator, insofar as the conditions provided by law are fulfilled;
- the right to opposition – in terms of processing activities, it can be exercised by submitting a request according to the ones indicated below;
- at any time, for reasons related to the particular situation of the data subject, that the data concerning him/her are processed based on the legitimate interest of Profinox or on the basis of the public interest, except where Profinox can demonstrate that it has legitimate and compelling reasons that justify processing and prevail over the interests, rights and freedoms of the data subjects or that the purpose is to establish, exercise or defend a right in court;
- at any time, free of charge and without justification, that the data are processed for direct marketing purposes.
- the right not to be subjected to an automatic individual decision, respectively the right not to be the subject of a decision made solely on the basis of automatic processing activities, including the creation of profiles, which produce legal effects concerning the data subject or similarly affect him/her in a significant measure;
- the right to address the National Supervisory Authority for Personal Data Processing or the competent courts, insofar as you deem it necessary.
